For the past few days, you all are hearing about the demolition of the twin tower constructed by Supertech in Noida. This article will help you to know the exact reason behind the demolition of the Twin Towers in Noida. The demolition took place at 2.30 pm on the afternoon of 28/08/2022. It was the vast 40-storeyed building that was destroyed within 12 seconds.

 

The Emerald Court’s Apex (32 storeys) and Ceyane (29 storeys) towers, which are taller than Qutub Minar in the national capital, were found to be in violation of multiple construction regulations, prompting a prolonged legal battle in the Allahabad High Court and then the Supreme Court of India, which ended in favor of the Residents Welfare Association.

 

The story began in 2004 when the New Okhla Industrial Development Authority (NOIDA) allotted a plot to Supertech Ltd for the development of Emerald Court, a housing society.

 

The Authority approved the building plan for the construction of 14 towers with 10 floors each for a housing society in 2005, in accordance with the New Okhla Industrial Development Area Building Regulations and Directions 1986. Supertech was granted permission to build 14 towers of 10-storey each with a maximum height restriction of 37 meters was imposed. The project was originally planned to include 14 10-story towers, a shopping complex, and a garden area.

 

The company received additional land for construction in June 2006, with the same terms. The plan was amended. According to the new plan, two more towers would be built, and the garden would be trashed.

 

In 2009, the final plan called for the construction of two 40-story towers, Apex and Ceyane while it was yet to be approved by the concerned authority.

 

The Residents Welfare Association petitioned the Allahabad High Court in 2011. The UP Apartment Owners Act, 2010, was allegedly violated during the towers’ construction. The homeowners claimed that the distance between the two towers was less than 16 meters, which was illegal. The original garden space designated in the original plan was allegedly used to build the twin towers.

The Authority approved the new plan proposed in 2009 in 2012, ahead of the start of hearings in the Allahabad High Court.

 

The Allahabad High Court ruled in favor of the RWA in April 2014, also ordering the twin towers to be demolished. It requested that Supertech demolish the towers at its own expense and refund the homebuyers’ money, plus 14 percent interest. In May 2014, the Noida Authority and Supertech petitioned the Supreme Court, claiming that the twin towers were built in accordance with the regulations.

 

However, in August 2021, the Supreme Court upheld the Allahabad High Court’s order and ordered the towers to be demolished, while also stating that the construction was illegal.

 

The Supreme Court has stated that the demolition date may be confirmed as August 28, within seven days between August 29 and September 4, to account for any minor delays due to technical issues or weather conditions.
